Policy regarding the Digital Millennium Copyright Act (DMCA). We comply with the DMCA and other applicable copyright laws.
We may not be aware that the use of the relevant intellectual property or means of individualization contained in such material is unlawful. Therefore, upon receipt of a written statement from the copyright holder about the infringement of intellectual rights indicating the page of the site and/or the network address on the Internet where such material is posted, we promptly take the necessary and sufficient measures to stop the infringement of intellectual rights.
Copyright Infringement Notice
If you believe that material on tomilo-lib.ru infringes your copyright, you may write a notice of infringement and send it to our agent's address, and the tomilo-lib.ru service will immediately block the materials listed in the notice.
Notice Requirements
Section 512(c) of the Copyright Act (Digital Millennium Copyright Act) imposes certain requirements on the form of this notice. Accordingly, it must be provided in writing and must contain the following information:
- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed. If multiple copyrighted works are covered by a single notification, provide a representative list of such works.
- Identification of the material that is claimed to be infringing and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the service provider to locate the material. You must provide the original URL of this material.
- Information sufficient to permit us to contact you, such as an email address, mailing address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Counter-Notification
If you believe that material was removed or access to it was disabled as a result of mistake or misidentification, you may submit a counter-notification pursuant to Section 512(g) of the DMCA. It must include:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access was disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in the judicial district in which you are located (or any judicial district if you are outside the United States), and that you will accept service of process from the person who provided the infringement notification.
After receiving the above infringement notice, the tomilo-lib.ru service takes action within 3 (three) business days.
tomilo-lib.ru reserves the right to terminate service to account holders who have been found to be repeat infringers of copyright.
